Question:

Do all of the Decedent's intestate heirs agree to work together to settle the Decedent's estate?

If the intestate heirs are able to work together, probate without a will can still be relatively inexpensive.  Incapacitated persons and minor children cannot give legal consent, so they are unable to work together to consent to the settlement of the estate.

 

 

Yes, all of the heirs of the estate can work together to settle the decedent's estate.

 

No, one or more of the heirs cannot (because they are incapacitated) or will not cooperate in the settlement of the decedent's estate.
